    Service Agreement

    Thank you for choosing The Mack Master Professional Organizing as a partner to master your space. We provide expert organizing services for residential and commercial spaces nationwide and provide coaching through a virtual platform for DIY customers, while establishing a safe place for clients’ wellness by ridding the clutter.

     

    Before we begin work together, it is important to review the following terms, as it is helpful when both parties are clear on expectations. As a Professional Organizing business, we value you and your growth in the process. Your confidentiality and trust are of the utmost importance. Listed below are our terms of service that define our process and service.

    By scheduling The Mack Master Professional Organizing services by telephone, email, text message or private message, the Client accepts and agrees to The Mack Master Professional Organizing Service Agreement that services are being performed in accordance with but not limited to the clauses below:

     

    Cancellation Policy

    Due to the high demand in our business, a last-minute cancellation often results in lost income and time for the Organizer(s). Due to this irreplaceable loss, we require a minimum of 48-hours' notice of cancelation.

     

    Any appointments canceled within fewer than 48-hours prior to appointment time will incur a cancellation fee of $59.

     

    No show appointments will incur a $100 fee per session, regardless of the number of hours scheduled.

    Hands-on organizing sessions begin at the scheduled time, regardless if the Client is delayed.

     

    The Mack Master reserves the right to waive fees for special circumstances as determined by management. To do so is at the sole discretion of management and does not in any way alter or waive any portion of this Agreement. We do, however, understand that emergencies happen and therefore allows each client one grace pass per calendar year to reschedule without penalty. There is no grace pass for no-show appointments.

     

    If late cancellations become routine, The Mack Master reserves the right to expect payment in advance for the entire session or refuse future services altogether.

    Communication

    The Client accepts being contacted via text message, email, and/or phone call.

    Confidentiality

    The personal information of and in possession of the Client will be treated confidentially and with respect at all times. During the course of our service, we may come across items of a private or personal nature. It is our policy and is strictly enforced that no personal or private information is ever shared with anyone else. This includes name, address, phone number. Staff members may share information with The Mack Master Professional Organizing only. Non-Disclosure Agreements are available upon request.

    Disruption of Service

    The Mack Master reserves the right to terminate this Agreement for the following reasons:

    • Repeated cancellations and rescheduling
    • Client or family members engage in disruptive, threatening or violent behavior, which can include but is not limited to yelling, verbal abuse, threats (outright or implied)
    • Non-payment
    • Unsafe or unsanitary working conditions

    Items for Disposal

    As a complimentary service The Mack Master will, at the Client’s request, transport or schedule pickups for donation items to the appropriate locations. Clients may elect to dispose of items personally as well.

    Liability

    The Mack Master nor their employees or contractors, is not liable for any loss due to damage to property, self or disposition of items. The Client retains full responsibility, unless gross negligence or intentional damage has been proven.

    Pets

    We are pet friendly but appreciate that pets are secured and safe on organizing days. Our office should be made aware of any special requirements in safeguarding pets.

     

    For health reasons, our staff is instructed to leave certain items and/or areas untouched; pet homes/beds, litter boxes, vomit and/or fecal matter. Our teams are advised to organize around these areas.

    Process Ownership

    Regarding the editing, sorting, and organizing of items, the Client maintains process ownership. The Mack Master recognizes items as the sole property of the Client, and though efforts will be made to help reduce the volume of belongings, when necessary, it is hereby stated that the final decision on such matters belongs to the Client.

    Project Outcome

    Project outcomes depend on the Client’s willingness to participate in the process; sorting, editing, and donating when necessary. Long-term maintenance of organization hinges on the Client’s commitment to maintaining the order, and quantity of items in the space. We do, however, want you to be 100% satisfied with our services. We are willing to work together to come up with a suitable solution and should be negotiated between the Client and the Owner of The Mack Master, not the employee.

    Photo/Video Release

    The Client releases all rights to before and after photos and/or video footage, to be used by The Mack Master® for marketing purposes, including but not limited to website, social media, educational presentations, and pamphlets. Client identity and confidentiality will always be top priority in regard to photo usage.

    Privacy and Confidentiality

    The Mack Master takes your privacy very seriously. At no time will we ever share any Client information with any outside source.

    Supplies and Shopping Assistance

    The Mack Master will either make suggestions about necessary supplies to be purchased and will shop for and purchase the supplies, making certain they are delivered to the Client’s location. Clients are responsible for all agreed-upon supplies (file folders, labels, shelving, containers, hooks, etc.) necessary for completion of the project and the fee for shopping and returns. The standard hourly rate of $75 will apply for all shopping and returns completed after the complimentary hour of shopping has been redeemed. Receipts for funds spent on Client’s behalf will be presented via an updated or separate invoice.

    Tardiness

    Many things can impact our schedules, including cancellations, lockouts, traffic delays, inclement weather, etc. Should our staff be running late to the appointment, Client will be notified as soon as possible and provided with a new expected time of arrival.

    Tipping

    The Mack Master never requires tipping but leaves it to the discretion of the client.

    Time of Performance

    All The Mack Master employees and contractors do their best to complete the work in a timely manner, however, all parties agree that time is not of the essence to complete any agreed upon work. While we do our best to work expediently, we also take into consideration the Client’s emotional, physical, and mental needs. We will adjust our speed of work for the best interest of the Client. Should the client opt for a service plan lesser than the proposed time to complete project goals, our staff will complete services within the clients' selected service plan timeframe; any and all remaining tasks will be left for 1.) client(s) to complete after our staff leaves, and/or 2.) client(s) to schedule another service session with us. If any provision of this contract is held unenforceable, then such provision will be modified to reflect the parties’ intention. All remaining provisions of this contract shall remain in full force and effect.

    Travel Time

    Sixty (60) minutes of round-trip travel time is complimentary (from Pelham, Alabama). Any additional travel time is billed at our standard hourly rate. Travel time between work sites is billed at our standard hourly rate. Travel fees may be waived at the sole discretion of management.

You also agree that you will not reproduce or redistribute the The Mack Master’s intellectual property in any way, including electronic, digital, or new trademark registrations. You grant The Mack Master LLC a royalty-free and non-exclusive license to display, use, copy, transmit, and broadcast the content you upload and publish. For issues regarding intellectual property claims, you should contact the company in order to come to an agreement.





Applicable Law

By visiting this website, you agree that the laws of Alabama, without regard to principles of conflict laws, will govern these terms and conditions, or any dispute of any sort that might come between The Mack Master LLC and you, or its business partners and associates.



Disputes

Any dispute related in any way to your visit to this website or to products you purchase from us shall be arbitrated by state or federal court in Alabama and you consent to exclusive jurisdiction and venue of such courts.





Indemnification

You agree to indemnify The Mack Master LLC and its affiliates and hold The Mack Master LLC harmless against legal claims and demands that may arise from your use or misuse of our services. We reserve the right to select our own legal counsel.







Limitation on Liabality 

The Mack Master LLC is not liable for any damages that may occur to you as a result of your misuse of our website. The Mack Master LLC reserves the right to edit, modify, and change this Agreement at any time. We shall let our users know of these changes through electronic mail. This Agreement is an understanding between The Mack Master LLC and the user, and this supersedes and replaces all prior agreements regarding the use of this website.
